1. Introduction

Welcome to GATE GOLD COMPANY FOR DESIGNING AND PROGRAMMING SPECIAL SOFTWARE ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our website located at gate-gold.com (the "Site") and the software services we provide (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

2. Services

We provide custom software development services, including but not limited to website creation, application development, and other programming services as agreed upon in a separate project agreement or statement of work.

3. User Accounts

To access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Payments and Fees

Fees for our Services will be set forth in a separate project agreement or invoice. All payments are due upon receipt of the invoice unless otherwise agreed in writing. We accept various forms of payment as specified on the invoice.

5. Refund Policy

Due to the nature of our services, all sales are final. We do not offer refunds for any services rendered. Please review our full Refund Policy for more details.

6. Intellectual Property

All intellectual property rights in the software, documentation, and any other materials developed or provided by us as part of the Services shall remain our property, unless otherwise agreed upon in a separate written agreement. Upon full payment, we grant you a non-exclusive, non-transferable license to use the deliverables for your internal business purposes.

7. User Conduct

You agree not to use the Services for any unlawful purpose or in any way that could harm the Company or any third party. You are prohibited from:

  • Violating any applicable laws or regulations.
  • Infringing on the intellectual property rights of others.
  • Transmitting any viruses, malware, or other malicious code.
  • Attempting to gain unauthorized access to our systems or networks.

8. Limitation of Liability

To the fullest extent permitted by law, in no event will the Company, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

10. Indemnification

You agree to defend, indemnify and hold harmless the Company and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Kuwait, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
